You must be a young whippersnapper. Or you have poor memory. In the early 90s, the first black supreme court justice, Thurgood Marshall retired. Bush the Elder nominated Clarence Thomas to replace Marshall. It was no secret that Marshall's replacement was going to be a black dude. According to today's right wing standards, that is DEI. Then used the race card during the judiciary hearings when Anita Hill accused him of sexual harassment while working at the EEOC.

Also, what makes Thomas a so-called constitutional scholar? He was chairman of the EEOC then had limited federal judiciary experience prior to becoming supreme court justice. Thomas' pre-justice credentials may be the least significant of the rest of the Justices.
