I'm no racing fan, but I've seen highlights of drivers get out on the track to call out another. just doing so is a tremendously unnecessary risk.

and the decision to go out on the track like that pretty much makes it impossible to find Stewart liable for anything, even if he, as some assert, did speed up intending to have his back end side swipe him. You'll never be able to prove that to a jury, and I don't think it's possible to establish proximate cause in a negligence case either, but civil law is admittedly not my specialty.

Agreed. The 20 year old driver really put himself in a dangerous spot, especially considering the track conditions and lighting. Unless it can shown that Stewart intentionally veered into the 20 year old, I don't know how he can be held liable. Tragic situation and I'm sure Stewart feels awful about what happened.
