Rahm Emanuel called it an injustice.

This often happens if the prosecution or the police made a serious procedural error in their investigation that would have made a trail unnecessarily difficult.

The police holding a press conference basically declaring Smollet guilty to the public probably did them no favors. This was such a high profile case that the defense might have been able to argue (probably not unreasonably) that the potential jury pool was permanently poisoned and that Smollet would not have been able to get a fair trial.

That being said, the fact that they kept his bail payment means he almost certainly did it.

This isn't what happened. There wasn't a trial or plea deal. There was no sentencing.

16 grand jury felony indictments where dropped, all records sealed, his criminal record fully expunged, the bond was retained and 16 hours of community service that was done in the past was counted as a condition of dismissal.

Smollett’s work with Rainbow PUSH included speaking to students about the music and film industry and volunteering in the PUSH Freedom Store, where he managed sales and peddled merchandise.

The SA lied when she said she had recused herself from the case - walking it back by saying it wasn't a "formal" recusal. She said she did it "colloquially". Seriously, that is what she said.

Then JS held a press conference saying he was innocent and told the truth. That alone was crazy.

No written records of the agreement where filed in any court. The case was scrubbed from databases.



Chicago PD wants a federal investigation.

The way this went down is unprecedented.

I don’t trust Rahm here one bit. He’s an Obama lackey and Michelle’s CoS emailed the foxx lady. Weird timing with Trump being exonerated and ACA being ruled unconstitutional. Something more going on here IMO...

Huh? Kraft pleaded not guilty and requested trial by jury. The deal he was offered would have required a fine, classes, community service, and admitting guilt.

Not getting a record expunged, sealed, and no guilty verdict. And he did not have political buddies make phone calls for him.

And what does Kraft have to do with Smollett case?

But then the DA would have said that so they would not be taking the beating they currently are.

And if that is the case there would have been no reason to have to call Michelle Obama's Chief of Staff. Also, the DA Foxx would not have emailed the attorneys in her office asking them to dig up examples of cases where roughly 18 felonies were committed, the case dropped, and sealed.

re: kraft, his public statement sounded like an apology/guilt. weird.

those who have more wealth and connections have more leverage, like in other areas/situations.
unfortunately the flip side in criminal "justice" is true as well: the poorer average Joes get cornered into plea deals even when innocent, no trials, faulty evidence, etc.

Due to the fact most call this decision an injustice, it seems most surprising that we have seen no protesting in Chicago. Everything gets protested in Chicago why not this????.

Very good point. Everything about this case is strange. Smollett lost his job - do you think he will get it back? I would think fans would object but who knows?

I would guess that he gets his job back and that some similar circumstances become a storyline in the show.
Goes to the idea that there is little to no bad publicity in the entertainment industry.

I definitely do not disagree with that. And it was strange that Kraft apologized and then plead not guilty.

LOL! Utter brilliance on your part to conclude that the police and mayor are holding press conferences to denounce the state attorney's actions when...according to you the state attorney is running cover for them.

Oh and the state attorney says the case was sealed "on accident".

Maybe something like failure to inform "defendant of his rights" [Miranda] or other "must do" failure??? But why seal everything????? Explanation of "by mistake" Curious.

The manner in which this case was dismissed was abnormal and unfamiliar to those who practice law in criminal courthouses across the State. Prosecutors, defense attorneys, and judges alike do not recognize the arrangement Mr. Smollett received. Even more problematic, the State’s Attorney and her representatives have fundamentally misled the public on the law and circumstances surrounding the dismissal.

When an elected State’s Attorney recuses herself from a prosecution, Illinois law provides that the court shall appoint a special prosecutor. See 55 ILCS 5/3-9008(a-15). Typically, the special prosecutor is a neighboring State’s Attorney, the Attorney General, or the State Appellate Prosecutor. Here, the State’s Attorney kept the case within her office and thus never actually recused herself as a matter of law.

The fact there was an alternative disposition in this case is not and should not be viewed as some kind of admission there was something wrong with the case, or something wrong with the investigation that the Chicago Police did.”
