Biden wants Dr Oz and Herschel Walker out.

Regardless of any political differences between these two and Biden, it's a violation of the Hatch Act for them to continue in their current role.
 
While the reporting implies its a political hit by Biden legally the two must step down or end their Senate campaigns to be in compliance with the Hatch Act.
 
As somebody who is required to take an annual Hatch Act training this is not completely true and as a SGE they fall under different parameters. This article explains it very well.

A good clarification. Sounds like the next thing to consider is what's mentioned in both articles linked in this thread that there is a Biden administration policy that prevents candidates running for office from serving on presidential advisory boards. If, indeed, it can be demonstrated that this policy has not been applied consistently, then an argument for this being a political move has more weight.

I dont know about the policy but if it's there I wouldn't doubt that it was crafted for the purpose of Walker who everybody knew was going to run and will likely beat Warnock (sp). The general rule for SGEs (and others) is that you can't use your position in the association of political activities. E.g. both should not reference their work in campaigning or campaign lit. To me this is a silly fight. Nobody is influenced to vote cuz these guys are on a Board nobody heard of. Now you just look petty.

To determine either way, we'd need to know when said policy was created. If it was already in existence before these two announced their candidacies (and if it's been similarly applied to any Democratic candidates in a similar position), then it's hard to argue it was there for the express purpose of giving an excuse to oust political rivals. To me, it seems the particular advisory board in question isn't one that the president would deem it particularly important to oust people he disagrees with. I agree that it's a bit of a silly fight, as you put it. It seems barely newsworthy, I think.

I don't know that we'll be able to get that information, though, as it seems unlikely this policy was publicly announced until such time as it was necessary to apply it. I'm sure there are many administration-level policies that are known internally that the public doesn't know about and that this is true of every administration.

Regardless of whether the policy was created for political purposes, in the abstract, it seems a sensible one, as long as it's applied consistently. Seems best to attempt to keep non-political positions from becoming partisan. It could very well be that a good policy (arguable, I know) was created for a bad reason, but, in that case, it'd still be a good policy.

Yep. He's petty and I think it may save the Republicans from having him run again. He's going to get his ass handed to him in several primaries this year where he's trying to play king maker.

If you'd get your head out of your ass and review my posts you won't find me being his routine defender. He had good ideas that had our economy rolling for all that wanted a job. He was also an arrogant idiot. He has a giant ego but I don't think you'll find many that run for office that don't have that.
